First: file the asylum application properly
The clock does not start when you decide to seek asylum. It starts when your Form I-589 is properly filed. If your case is in court, that means filing it with the immigration judge, not USCIS, and having it entered in the record. Ask for the stamped receipt and keep it: it proves the date that counts.
If you filed affirmatively with USCIS and the case later moved to court, the original date usually carries over — but that is exactly the sort of detail worth confirming with a lawyer.
The waiting period
The law bars an asylum applicant from receiving employment authorization immediately: a waiting period runs from filing. The exact length and the conditions attached have changed several times in recent years, through rulemaking and federal litigation.
So the practical rule: before preparing the I-765, confirm the period currently in force on the USCIS page for asylum-based employment authorization, or with a lawyer. Filing early means rejection, and weeks lost with it.
The asylum clock, and how it stops
USCIS and EOIR keep an internal counter known as the asylum clock. It stops when delay is attributable to you:
- Requesting a continuance to find counsel or prepare.
- Declining the first individual hearing date offered.
- Failing to file documents or translations by the deadline.
- Missing a biometrics appointment.
System delays should not stop the count. In practice the clock is sometimes stopped in error, and you can ask the court to correct it — worth catching early.
There is a real tension here: requesting a continuance may be right for your asylum case and simultaneously delay your work permit. That is a decision to make with a lawyer, not in the courthouse hallway.
The application: Form I-765
- Category: (c)(8), pending asylum.
- Documents: a copy of the I-589 with its receipt stamp, photo identification, passport-style photos per the instructions, and proof of the filing date.
- Fee: I-765 fees have changed repeatedly. Verify the exact amount and fee waiver options on the USCIS fee page the day you file. An incorrect payment gets the entire package returned.
- Filing: to the address in the current instructions, or online where the category allows.
Once approved you receive an EAD card with an expiration date, which also lets you apply for a Social Security number.
Renewals
The EAD for pending asylum renews while the case remains open. File the renewal well before expiration; processing times vary widely. Automatic extensions exist for certain categories when the renewal is filed on time — confirm whether yours qualifies.
If asylum is granted, your situation changes: asylees are authorized to work by virtue of status, though keeping a document that proves it to employers is sensible.
If asylum is denied
While a BIA appeal is pending, the permit may remain renewable. Once the order becomes final, it ends. People granted withholding or CAT protection can obtain work authorization, through a different route.
